The Civil False Claims Act is the federal government's primary enforcement and litigation tool in combating health care fraud and abuse. The Department of Justice and other enforcement agencies rely heavily on these provisions for several reasons including the government's burden of proof is less than with criminal provisions and, as we will discuss, sanctions and penalties for violating these civil provisions are substantial. Laboratories and pathologists must be aware of the Civil False Claims Act and the types of conduct that can trigger enforcement actions and prosecutions.
