We often talk about compliance with federal anti-kickback provisions. Failure to understand these criminal provisions can lead to devastating consequences for health care providers. Just last week on April 20, a 73-year-old physician was sentenced to 2 years in prison for violating federal anti-kickback provisions. Earlier, the physician had pled guilty to accepting bribes in the forms of sham service agreements and outright illegal cash payments. The Department of Justice announced that this physician received as much as $10,000 a month from a clinical laboratory in return for referring patients. The owners of the clinical laboratory and 26 other physicians have also pled guilty in this very large and blatant bribery scheme.<....
