In 2006, the OIG finalized an anti-kickback statute safe harbor concerning the provision of Electronic Health Records (EHR) items and services. The safe harbor sets forth the requirements an organization must fulfill if the organization plans to provide EHR items and services to referral sources. For several years now, larger provider organizations have used these regulatory provisions to aid their referring clients in obtaining, implementing, and maintaining EHR systems. Although the costs of such items and services can be substantial, the federal government allows these arrangements in an effort to encourage all providers to adopt electronic records and communications.
