Welcome back everyone. Summer is officially over. Our first Friday Compliance Briefing of the fall concerns a marketing practice we have heard about from several subscribers that may represent a violation of the anti-kickback statute. We appreciate the input from our subscribers and we are always looking for ideas and suggestions for future Friday Compliance Briefings. FREE TESTING
Several of our subscribers that manage clinical laboratories have asked us recently about the marketing practice of providing free testing to potential customers. The practice is intended to allow the potential customer, typically a physician practice, to become familiar with the laboratory's services and test the accuracy and usefulness of its testing. As you will see, this practice does not create a compliance issue as long as the laboratory carefully....
