This past week has been exciting from a legislative point of view for clinical laboratories, pathologists, and other diagnostic providers. Prior to the Fourth of July Holiday, Congress failed to pass an expected legislative fix concerning the physician fee schedule. However, shortly thereafter both houses of Congress passed legislation that not only fixed the impending decrease in the Medicare Physician Fee Schedule, but also included important provisions concerning the laboratory competitive bidding demonstration, future update to the Medicare Laboratory Fee Schedule, and the grandfather clause that allows independent labs to bill for technical components of pathology services provided to hospital patients.
In yet another twist, President Bush vetoed the bill on July 15, because it included cuts to the Medicare HMO or Advantage programs. A few hours later, however, Congress voted to....
