The latest CodeMap TeleConference on September 13, concerning fraud and abuse legislation, prompted a significant number of subscribers to submit questions concerning the Stark II Self-Referral Prohibitions. This is not surprising, considering the complexity of the legislation, as well as the length of time CMS took to publish the final regulations. In addition, CMS' numerous versions of proposed regulations published over a nearly ten year period certainly confused providers even more. Two issues continue to generate many questions; one, how do the Stark II regulations affect the provision of specimen collection supplies and lab result reporting systems; and two, how do the regulations affect the structure of physician office labs.
