Editor's Welcome

Recently, the Office of Inspector General (OIG) offered guidance concerning when and how providers may offer discounts to uninsured and underinsured patients without running afoul of federal laws and/or regulations. On June 24, 2004, the Chief Counsel to the Inspector General testified before Congress concerning these discounts and compliance with federal rules and regulations. In particular the testimony concerned compliance with the Federal Anti-Kickback Statute, the OIG's exclusion authority prohibiting excessive charges, and the Civil Money Penalty prohibiting inducements to Medicare and Medicaid beneficiaries. This week we will examine all these provisions and how they affect a provider's ability to offer discounts to patients who cannot afford to pay for their care.
